He can bail out more than likely and be back in a day or so. Maybe not. No matter, you can’t legally touch the apartment until he i late as described in the rent agreement. Once that happens, you have to go through the courts to have him evicted. If you choose to follow another path and throw out his stuff and rent the place, he could sue and probably win.
